ISS Securities Class Action Services held an event in New York on October 9, 2014, during which ISS and leading international practitioners in securities class actions discussed trends in global securities litigation, addressed nuances to be aware of when opting in to participate abroad and shared how clients can benefit from the technology, experience and expertise that ISS Securities Class Action Services delivers to maximize client recoveries.
This session provided practical insights for pursuing investor claims across the globe. A high level overview of discussion points of interest:
- Activity in the Non-North American jurisdictions has sped up recently and will only continue to grow as those markets gradually evolve to more investor friendly aggrievement resolution processes and outstanding cases settle to show a true return on the effort.
- It is important for all institutions to examine their current procedureses for reviewing these litigations and have a process in place to recover all eligible funds. While investors should consult with their legal counsel regarding their fiduciary obligation to participate in all non-North American securities litigations, it is in the best interest of all investors to have a defined workflow in place for being informed of these cases and being able to determine the merits of participating.
